Senior Trump Officials Invoke State-Secrets Privilege Over Deportation Flights
In a rare internal-government clash, Attorney General Pam Bondi, Secretary of State Marco Rubio, and DHS Secretary Kristi Noem have invoked the state-secrets privilege to avoid releasing information about emergency deportation flights ordered under the Alien Enemies Act of 1798. The flights aim to deport Venezuelan nationals allegedly linked to the Tren de Aragua, a criminal group labeled a terrorist organization.
U.S. District Judge James Boasberg issued a temporary restraining order (TRO) to halt the deportations and requested flight data, including passenger lists and flight paths. In response, the officials claimed that releasing this information would threaten national security and diplomatic relations.
The court is now reviewing the materials in private (in camera) to decide if the privilege is valid. The judge emphasized the need to balance national security with judicial oversight and transparency, especially when constitutional rights may be at stake.
